Footbizz (“Footbizz,” “we,” “us,” or “our”), a company with its registered office at Bldg. No. 25, 3rd Floor, Phase-1, Central Market, Ashok Vihar, Delhi-110052 (India), manages and operates the Footbizz mobile application (the “Platform”). Footbizz is committed to protecting and respecting your privacy.

This Privacy Policy, together with the Footbizz Terms and Conditions and all other policies notified by us from time to time, governs your use of the platform. This Privacy Policy describes our policies and procedures on the collection, use, disclosure, sharing, processing, transfer, storage, retention, and safeguarding of the Information you provide to us through your use of the Platform and/or during your purchase of footwear on the Platform.

The term “User” or “Users” (“you” or “your”) refers to any individual or entity who uses, accesses, or browses the Platform and/or purchases footwear from the Platform.

1.1 By utilising the Footbizz app, you acknowledge and consent to our privacy practices. We collect and employ your information to deliver the app and its services. Your information is primarily gathered, stored, and processed within India, subject to Indian laws. You may access the app from outside India, but product availability may fluctuate across regions. If you disagree with our privacy practices, please refrain from using the app.

2. Data Collection:

2.1 Footbizz collects information like your name, address, phone number, email, messages, passwords, and financial information to provide app services and personalise your experience. You can access, update, or delete your information. Location information may be collected with your permission. You may choose not to provide certain information, but it may limit app features. By using the app, you agree to these practices and consent to our use of your information.

2.2 When you visit the Platforms, we automatically receive information including your IP address, browser type, operating system, and the URL of the site you visited prior to accessing the Platforms. This information is used to analyse user trends and improve our services. We do not share the link between your IP address and personally identifiable information with third parties without your consent, except as required by law. We may share aggregate findings in an unidentifiable form with advertisers and partners to support business growth. The amount of information we receive may vary based on your browser settings.

3. Children Policy:

Use of our Platform is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. We do not knowingly solicit or collect personal data from children under the age of 18(eighteen) years. If you have shared any personal data of children under the age of 18(eighteen) years, you represent that you have the authority to do so and permit us to use the information in accordance with this Privacy Policy

5.2 Your information may also be shared with our affiliates to provide a seamless shopping experience. We are committed to safeguarding your privacy and ensuring the security of your information.

5.3 Footbizz may disclose your information to external organisations or individuals if required by law, to address fraud or security issues, or to fight fraud and credit risk.

5.4 Footbizz may disclose or transfer your information to a third party as part of a reorganisation or sale of assets. We will ensure the new entity has appropriate security measures to protect your information.

5.5 Third-party payment gateway providers may collect your financial information for billing and payment purposes. They use secure digital platforms to protect this information. Footbizz is not responsible for the actions or inactions of these third-party providers.

5.6 While we take measures to protect your information, the internet is susceptible to security breaches. Exercise caution when providing personal or financial information.

5.7 We may share non-personal information with partners or third-party developers to improve their software, hardware, and services designed for use with the Footbizz app.

6. Retention and Storage:

6.1 We will retain your information and any data for the period necessary to fulfil the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted under the applicable law.

6.2 The Information collected on the Platform shall be stored and processed in India and shall be governed by the applicable laws of India ( including data protection and privacy laws)

Footbizz is committed to complying with the Digital Personal Data Protection Act, 2023 (DPDPA) and the Information Technology Act, 2000 (IT Act). These acts govern the collection, processing, and storage of personal data in India. 8.2 Your information is stored within secure networks accessible only to authorised personnel with specific access rights. These individuals are obligated to maintain confidentiality.

8.3 While we strive for maximum security, absolute security cannot be guaranteed. We are not responsible for breaches caused by factors beyond our reasonable control, such as government actions, hacking, or technical glitches.

9. User Rights:

9.1 We take every reasonable step to ensure that your personal information that we process is accurate and, where necessary, kept up to date, and any of your personal information that we process that you inform us is inaccurate (having regard to the purposes for which they are processed) is erased or rectified. You may access, correct and update your personal information directly through the functionalities provided on the Platform. 9.2 You have an option to withdraw your consent that you have already provided by writing to us at the contact information provided below. Please mention “for withdrawal of consent” in your subject line of your communication. We will verify such requests before acting on your request Please note, however, that withdrawal of consent will not be retroactive and will be in accordance with the terms of this Privacy Policy, related terms of use and applicable laws. In the event you withdraw consent given to us under this Privacy Policy, such withdrawal may hamper your access to the Platform or restrict provision of our products and services for which we consider that information to be necessary.

This Privacy Policy is governed by Indian law. Any disputes arising from this policy shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

12. Severability:

If any provision of this Privacy Policy is found to be invalid, it will be ineffective only to that extent, without affecting the validity of other provisions.
